What usually brings an officer

Which agency responds depends on where you are: city police within city limits, the California Highway Patrol on freeways and in unincorporated areas, and a county sheriff in some jurisdictions. On a freeway, expect the CHP.

What a police report actually is

It is an officer's account, usually written after the fact from statements and physical evidence. It commonly includes a diagram, statements, conditions, and sometimes an opinion about how the collision occurred or a citation. Insurers give it weight, and it is not binding on them — adjusters reach their own conclusions and occasionally disagree with the officer's.

If no officer attends

  1. Do your own documentation thoroughly, since it is now the primary record.
  2. Ask whether the agency accepts a counter report or an online report, and file one if they do. Practices vary between agencies.
  3. Report to your insurer the same day.
  4. Handle the DMV reporting duty separately, because it is triggered by the circumstances rather than by whether police attended.

Getting a copy later

Reports are usually available from the responding agency after a processing period, often for a fee, and you will need the report number, the date, the location and the names involved. Ask the officer for the number before they leave; retrieving it afterwards is much harder than writing it down at the time.

The honest position

A police report helps, particularly on disputed liability. It is not required for a claim, and plenty of straightforward claims are settled without one. If you did not get one, your photographs, your witness details and a prompt consistent account carry the weight instead.
