Situations where it usually is not worth it

Property damage only, with no injury. A clear-fault claim the other carrier has already accepted. A minor soft-tissue complaint that resolves in a couple of weeks. In these, the process is largely administrative, and a contingency fee comes out of a recovery that was not going to be seriously disputed. Plenty of people handle these themselves perfectly well, and we would rather say so than pretend otherwise.

Things to know before you sign anything

Ask how the fee is calculated and whether it changes if a lawsuit is filed. Ask whether case costs come out before or after the fee. Ask who will actually handle your file day to day. Ask what happens if you want to end the arrangement. A firm that answers all four plainly is telling you something useful.

What does not require a lawyer

Getting your own policy explained. Understanding a valuation. Following up on a slow adjuster. Filing a Department of Insurance complaint about handling. Those are things you can do, and things a good agent will help with at no extra cost.

The deadline nobody mentions

California limitation periods run whether or not you are negotiating. If injury is involved and time is passing, that is itself a reason to get advice sooner rather than later.

Many offer a free consultation. Using one to understand where you stand, then handling a simple claim yourself, is a perfectly reasonable path.

Will my insurance company give me legal advice?
